What legal documents should a parent have before needing care?

A durable power of attorney for finances, a health care power of attorney or advance directive, and an up-to-date will; a Tennessee elder law attorney can prepare or update them.

What if a parent can no longer make decisions and has no power of attorney?

The family may need to ask a Tennessee court to appoint a conservator, which takes time and money; ETHRA's region also has a public guardianship program for older adults with no one able to serve.

Can an assisted living community ask a resident to leave?

Yes, when needs exceed what the license allows or the contract's discharge terms apply; the contract should state notice periods, and the ombudsman can help you respond.

What should we do if a nursing home issues a discharge notice?

Call the East Tennessee District Long-Term Care Ombudsman at 865-691-2551 ext. 4223 the same day; federal rules protect residents of certified homes and give them appeal rights.

How do siblings share decisions about a parent's care?

Agree on who holds which power of attorney, share the same information, divide tasks by strengths (finances, visits, medical appointments) and meet regularly; a care conference at the community can help.

Who do we call if we suspect a parent is being financially exploited?

Tennessee Adult Protective Services at 1-888-277-8366, and the parent's bank; if a facility is involved, also contact HFC's complaint line at 1-877-287-0010.

Can family members be paid to care for a parent?

Yes, under a written agreement at fair market rates; TennCare CHOICES consumer direction allows some family caregivers to be paid, with rules on who qualifies.

Do out-of-state powers of attorney work in Tennessee?

Generally yes, but many Knoxville families have a Tennessee attorney review them so banks and facilities accept them without delay.

Should one sibling handle everything?

One sibling usually becomes the main contact for the community, but sharing financial records, visit schedules and medical updates with everyone in writing prevents most later disputes and helps if the main contact gets sick or moves.

What is a care conference and how do we ask for one?

A care conference is a meeting with the community's nurse, administrator or social worker to review the resident's plan of care; ask for one after any hospital stay, change in condition or complaint, and bring a written list of questions.
